TERMS OF SERVICE
These Terms of Service govern access to and use of www.evershe.in and purchases from EVERSHE. By using the website or placing an order, you agree to these terms together with the policies linked on the website. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.
ELIGIBILITY AND ACCOUNTS
You must be legally capable of entering into a binding transaction or use the store under the supervision of a parent or lawful guardian. You are responsible for accurate account information, safeguarding login credentials and activity undertaken through your account. Notify us promptly of suspected unauthorised use.
PRODUCT INFORMATION
We take reasonable care to describe products accurately. Colours may vary slightly because of lighting, photography, screens and natural variations in fabric, print placement, embroidery or handcrafted work. Measurements are approximate and should be read with the product-specific size guide. A variation does not remove any remedy that applies where goods are materially misdescribed or defective.
PRICES, TAX AND PROMOTION
Prices and applicable charges are displayed before checkout. EVERSHE may change future prices without notice. A confirmed order is governed by the price accepted at checkout, except where an obvious pricing or technical error requires cancellation and refund. Promotion codes are subject to their stated eligibility, duration and exclusions, have no cash value, and may not be combined unless expressly allowed.
ORDERS AND ACCEPTANCE
Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt, not necessarily acceptance. EVERSHE may verify payment, stock, delivery serviceability and order details before acceptance or dispatch. We may reasonably refuse, limit or cancel orders affected by stock discrepancies, suspected fraud or misuse, payment failure, pricing error, delivery restriction or breach of these terms. Amounts collected for cancelled items will be refunded.
PAYMENTS
Payments are processed through authorised third-party gateways. You represent that you are authorised to use the chosen payment method and that the billing information is accurate. EVERSHE does not control independent bank or gateway processing times.
DELIVERY, CANCELLATIONS AND RETURNS
Shipping, cancellation, return, exchange and refund arrangements are governed by the policies published on the website and incorporated into these terms. If there is an inconsistency, the term more protective of a non-waivable consumer right applies.
ACCEPTABLE USE
Do not use the website for unlawful, fraudulent, abusive or misleading purposes.
Do not interfere with security, introduce malicious code, scrape at unreasonable scale, impersonate another person or attempt unauthorised access.
Do not submit false reviews, misuse promotions, infringe intellectual-property rights or use EVERSHE content commercially without written permission.
INTELLECTUAL PROPERTY
The website and its original text, photographs, graphics, logos, trade dress and other content are owned by or licensed to EVERSHE and protected by applicable law. Limited personal use of the website does not transfer ownership or grant a commercial licence.
THIRD-PARTY SERVICES
The store may rely on or link to third-party services, including Shopify, payments, couriers and social platforms. Their separate terms may apply. EVERSHE remains responsible for its own obligations and does not disclaim liability that applicable law places on it.
REVIEWS AND SUBMISSIONS
If you submit a review, image or other content, you confirm that you have the right to do so and that it is truthful, lawful and does not violate another person's rights. You grant EVERSHE a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that submission for store and marketing purposes, subject to applicable privacy and advertising law. You may contact us about removal where appropriate.
DISCLAIMER AND LIMITATIONS
The website may occasionally be interrupted or contain technical errors. To the fullest extent permitted by law, EVERSHE is not liable for indirect or consequential loss that was not reasonably foreseeable. This clause does not limit liability or consumer remedies that cannot lawfully be limited, including responsibility for fraud, wilful misconduct, or qualifying defective or misdescribed goods.
INDEMNITY
To the extent permitted by law, you are responsible for loss directly caused by your unlawful misuse of the website or material breach of these terms. This provision does not require a consumer to compensate EVERSHE for EVERSHE's own breach or negligence.
SUSPENSION AND TERMINATION
We may restrict website access or cancel an account where reasonably necessary for security, fraud prevention, legal compliance or material breach. Provisions intended to survive termination, including payment, intellectual property, liability and dispute provisions, continue to apply.
GOVERNIGN LAW AND DISPUTES
These terms are governed by the laws of India. Subject to rights available under consumer-protection law and the jurisdiction of competent consumer commissions or other authorities, courts with lawful jurisdiction in Kerala may hear disputes. Please contact our Grievance Officer first so we can attempt a prompt resolution.
CHANGES, SEVERABILITY AND CONTACT
We may update these terms prospectively by publishing a revised effective date. If any provision is held invalid or unenforceable, the remaining provisions continue to apply. Questions may be sent to reach@evershe.in.
